Give The Valid Reason to Get Your Rented House Vacated
If tenant or any of his/her family members does not stay in the rented house for 6 months then in that condition he or she can be evicted from the house. Owner can also get the house vacated if he needs that for his own living purpose. There is lot of people who rent out their property for extra monthly earning. But it becomes a headache for them when they need that and tenant denies to vacate the house or shop. It becomes a dilemma as owner may need that house or shop for some serious purpose but they don't seem to be able to get their rented property back. In that condition they have some options which they can use.
There are laws in many state regarding this but in most of the states there is provision in rent control act that owner cannot force the tenant to vacate the house or any other property without any firm reason. Generally rent controller will not issue an order to tenant to vacate the house in common situation. It is only done on some special situation so if you want your house or shop get vacated you need to appeal a request with valid and firm reasons which are as follow.
1) Building is unsafe or needs major repairs - Building has become unsafe or unsuitable to live and owner wants it to be repaired. Apart from this owner may need to get some major changes in his building but this change should be in social welfare.
2) Nonpayment of rent - If tenant does not pay the rent till two months of decided date then he or she can be ordered to vacate the house. If tenant pays the rent or deposits at court then he or she cannot be ordered to vacate the house but if tenant has taken the benefit of it once then it will not apply on him/her again.
3) Use of rented property for some personal benefit - If tenant is not using the rented property for the purpose it was given and is using it for its personal benefit without owner permission then own can give him/her a notice to stop misuse use of property. Still if tenant does not stop his/her activities within the month of receiving the notice then the rented property can be vacated.
4) If residential place is not under use - If tenant or any of his/her family members does not stay in residential property for 6 months then house can be vacated from him/her. If owner needs the rented house for his/her own living purpose then also the house can be vacated.
5) To rent out the already rented house without any permission - Tenant may rent out the place to someone else without the owner permission. If the property rented out for business or professional work is given to someone else without owner permission then that place would be taken as to let and can be vacated from the tenant.
